Cal Savers:  Mandatory Deadline Approaches for Businesses of 5 Employees or More
CalSavers is California’s new retirement savings program that will offer millions of workers in California the opportunity to get on track for the future.
CalSavers is available to California workers whose employers don’t offer a workplace retirement plan, self-employed individuals, and others who want to save extra.  Savers contribute to an Individual Retirement Account (IRA) that belongs to them.  Employers that don’t offer their own plan will register for CalSavers by June 30, 2022 and facilitate their employees’ access to the program.

Criminalization of Wage Theft – AB 1003
A new CA law now makes it a felony if an employer, with intention, wrongfully fails to pay wages, including tips, in an amount greater than $950 from one employee, or $2,350 in the aggregate from two or more employees, within a 12-month period. With this new law independent contractors are considered employees. The consequence for failing to pay employees can result in a criminal charge of grand theft and potential imprisonment for up to 3 years. Examples of wage theft could include paying less than minimum wage, failure to pay overtime, failure to provide compliant meal and rest breaks, and/or requiring employees to work off the clock. As such AB 1003 targets managers and supervisors tasked with implementing personnel policies related to compensation and meal and rest breaks, those responsible for overseeing timekeeping practices, and those superficially tasked with providing wages and breaks to employees in California.  To read the law click here.
